The recent changes come from decisions over the past 18 months in the Supreme Court and the Court of Appeals for the Federal Circuit (CAFC).The proposed changes are contained in the Patent Reform Act 2007, currently going through the legislative process.The judge-made changes are without exception anti-patentee, while the legislative changes bring about fundamental reforms to the US patent system, bringing it more in line with the rest of the world.
